Federal Sites & Links

Federal laws that govern the provision of educational services for students with disabilities include the following.

* The Individuals with Disabilities Education Act (IDEA), and its associated regulations (Title 34 Code of Federal Regulations Parts 300 and 301

* Section 504 of the Rehabilitation Act of 1973 (Section 504), and its associated regulations (Title 34 Code of Federal Regulations Part 104)

* The Americans with Disabilities Act (ADA), and its associated regulations (Title 29 Code of Federal Regulations Part 35 & Sections 1601 and 1640)

* The Family Educational Rights and Privacy Act (FERPA), and its associated regulations (34 Code of Federal Regulations Part 99)


The United States Department of Education (USDOE) has primary responsibility for the administration of the above-mentioned laws and regulations. The Office of Special Education Programs (OSEP/OSERS) is the office within the USDOE that administers the IDEA. The Office for Civil Rights (OCR) is the office in within the USDOE with responsibility for administering Section 504 and the ADA. The USDOE?s Family Policy Compliance Office (FPCO) administers FERPA.
